Loyalty Terms of Use

These Terms of Use ("Terms") govern your participation in the Mealzy Loyalty program (the "Program"). By registering, accessing, or using the Program, you agree to these Terms.

1. Eligibility & Account

• You must be at least 18 years old to join the Program.
• One account per person. You are responsible for safeguarding your login credentials.
• Provide accurate, complete information and keep it up to date.

2. Program Benefits & Points

• Rewards, benefits, and point-earning rules may change at any time.
• Points have no cash value, are non-transferable, and may expire at our discretion.
• We may correct, deduct, or refuse points for suspected abuse, error, or fraud.

3. Communications & Marketing

• By signing up, you consent to receive transactional communications (e.g., login emails, account notices) and marketing or promotional communications about Mealzy products, services, and offers.
• You may opt out of marketing emails at any time by using the unsubscribe link in the message. You will continue to receive essential transactional communications related to your account and the Program.

4. Acceptable Use; Fraud Prevention

• No automated scripts, scraping, or attempts to game, exploit, or circumvent Program rules.
• We may suspend or terminate accounts for suspected abuse, fraud, or policy violations.

5. Changes, Suspension & Termination

• We may modify or discontinue the Program, or any part of it, at any time.
• We may update these Terms from time to time. Continued use constitutes acceptance.
• We may suspend or terminate your participation at our discretion.

6. Disclaimers; No Warranties

The Program and all related services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Mealzy disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Program will be uninterrupted, timely, secure, or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, in no event will Mealzy, its affiliates, or their respective owners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your participation in or inability to use the Program. To the extent liability cannot be disclaimed, the aggregate liability of Mealzy for all claims relating to the Program will not exceed one hundred (100) USD.

8. Indemnification

You agree to defend, indemnify, and hold harmless Mealzy and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Program, your violation of these Terms, or your violation of any rights of another.

9. Governing Law; Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Mealzy is established, without regard to conflict of laws rules. Any dispute will be resolved through binding arbitration on an individual basis, and you waive any right to participate in a class action or class-wide arbitration, to the extent permitted by law.

10. Miscellaneous

• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
• Severability: If a provision is unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms; we may assign as permitted by law.
• Entire Agreement: These Terms, with the Privacy Policy, form the entire agreement for the Program.
